  This lease is made by and between you the GUEST and JSRE/Destin Management Group, LLC.

Age Requirements

We do not rent to anyone under 25 years of age unless accompanied by an adult guardian or parent. We do not rent to vacationing students or chaperoned groups. Sorry, no exceptions. Any violators will be evicted according to Florida Statue 508.141 with forfeiture of all monies.

Cancellation or changes of reservation with deposit payments.

Cancellations require a (60) day notice of cancellation or the full deposit amount will be lost. Cancellations outside of (60) days will forfeit a minimum of $100 processing fee. Changes that are made more than (60) days prior to check in will not be penalized. Any changes made within (60) days of check in date that result in a shortened stay, change of dates, change of location or unit, will result in the guest forfeiting full payment plus deposit. In the event that the unit is re-booked, your deposit will be refunded, less $100 processing fee and any difference in the rental rate due to last minute booking or costs incurred to re-book the unit. The home may not be sublet.

Check-In Time

Check-In time is after 4:00 p.m.

Check-Out Time

Check-Out time is 10:00 a.m.

**Please note: There will be a $50.00 charge for each lost or unreturned house key and/or garage remotes.

Cleaning

While linens and bath towels are provided in the unit, daily maid service is not. Please bring your own beach towels, as we do not permit linens and bath towels to be taken from the unit.

Deposit Guarantee

Advance Payment Requirement – We require a minimum advance deposit of 35% of the Total at the time of booking, by check, cashier’s check or money order. The advance payment will be applied toward the total rent. Advance payment is not a damage deposit. See Damage Deposit Requirement below. A damage/security deposit may be required for the full rent to be paid 90 days prior to arrival.

Peace of Mind/Damage Waiver

Damage Deposit Requirement – A damage deposit is required at all locations. This must be received (60) days prior to your arrival along with the remaining balance due. If you are arriving within (60) days of booking your reservation, we must receive your deposit within (2) business days. The deposit automatically converts to a security/damage deposit upon arrival. The damage deposit does not apply toward the rent. The damage deposit is fully refundable within fourteen (14) days of departure provided the following provisions are met:

1. No damage is done to the property or its contents beyond normal wear and tear.

2. All debris, rubbish, and discards are placed in their proper containers and soiled dishes are placed in the dishwasher.

3. All keys and remotes are left with management (or other specified location).

4. All charges accrued during the rental period are paid-in-full prior to departure.

Mandatory Evacuation

Hurricane Policy- No refunds will be given unless:
a. The National Weather Service advises that we are in a "Tropical Storm/Hurricane Warning Area" and /or
b. A "Tropical Storm/Hurricane Warning" has been issued for the area of residence of a vacationing guest. The day that the National Weather Service advises that we are in a "Tropical Storm/ Hurricane Warning Area" you will be refunded:

1. Any unused portion of rent from a guest currently registered,

2. Any unused portion of rent from a guest that is scheduled to arrive and wants to shorten their stay to come in after the "Tropical Storm/ Hurricane Warning" is lifted; and

3. Any advance rents collected or deposit for a reservation scheduled to arrive during the "Tropical Storm/Hurricane Warning" period.

Occupancy

Maximum Occupancy- The maximum number of guests is limited to 12, no exceptions please.

Pet Policy

Pets are NOT permitted in this rental unit. Violation of this will occur in forfeiting deposit.

Rates

Rate Changes – Rates subject to change without notice. Reservations are encouraged and will be accepted up to 1 year in advance.

Smoking

This is a non-smoking house. Smoking is only permitted outside.

Swimming Pool

Please note there is a swimming pool located in the neighborhood or on the premise of this rental unit and no lifeguard or other safety personnel are provided. Guests use the pool and other premises at their own risk. Guests agree to indemnify and hold harmless the owner from any claim, loss or expense (including attorney's fees and court costs of the owner) by guest or guest invitees.

Elevator Policy

Please note there may or may not be an elevator located in the property. Damage to or destruction of elevator equipment or walls is strictly prohibited. Elevator equipment must not be tampered with, as the mechanism controlling elevators is highly sensitive. Misuse of elevator mechanisms, such as forcing doors, removing panels, tampering with fire equipment, or damaging electrical control equipment, is a serious and dangerous offense. Any person causing damage or destruction of elevator equipment or machinery will be responsible for any fees required to correct the damage. All elevators are checked for proper operation prior to arrival. If you break it due to negligence or kids playing in it, you will also be charged for service repairs. Use at own risk.

INDEMNIFICATION AND HOLD HARMLESS - Guest acknowledges and understands that each and every guest or guardian is solely responsible for any property damage, accident, injury, or loss sustained to any person while in-residence, and neither the Agent nor the Owner accepts legal or financial responsibility. Guests and guardians assume all risk of injury or other losses resulting from the use of residence or any other recreational activity while staying at the residence and will hold the Agent and/or Owner harmless with respect hereto. Guests hereby agrees to indemnify and hold the Agent, Employees, Officers, Contractors and.or Property owner harmless from any claims, including those of third parties, arising out of or in any way a result of guests use of the premises or items therein.

Terms and Conditions

  1. Full Payment Due – Before check-in time. Please make payments in the form of personal checks, business checks, cashier’s checks, bank money orders or cash.
  2. Falsified Reservations – Any reservation obtained under false pretense will be subject to forfeiture of advance payment, deposit, and/or rental money and the party will not be permitted to check in.
  3. Units for Sale – In the event a property that you are renting is listed for sale, we may find the need to show the property during your visit. We will make every effort to schedule the showing at a convenient time so we do not disturb your vacation.
  4. Unit assignments are NOT GUARANTEED!!! In the event that a property sells between booking & arrival date, we will make every effort to offer a comparable property or offer a full refund.

Spring Break Policy

Renter hereby stipulates that he/she is at least 25 years of age and will occupy the premises full time during this rental period. ANY renter who violates this agreement will be evicted and will have all rental monies forfeited. We do not rent to vacationing students or singles under 25 years of age unless accompanied by an adult guardian or parent. The parent/child ratio of 1 adult for every 2 children applies during Spring Break. Our home is monitored during Spring Break for violation of this policy. All violators will be evicted and all rental payments and/or security deposits WILL be forfeited. This also applies if the rental agreement is signed under false pretenses. No chaperoned groups.
